ISLAMABAD: (Suno News) The Supreme Court dismissed the Punjab government’s appeals seeking physical remand of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan.

A three-member bench headed by Justice Hashim Kakar heard the case, noting that the Punjab government may approach the trial court if it wishes, but emphasized that Khan’s lawyers reserve the right to challenge any such move.

“It has been over a year and a half since the arrest — the question of physical remand simply does not arise anymore,” Justice Kakar remarked.

Punjab’s Prosecutor General told the court that photogrammetric, polygraphic, and voice matching tests were pending for the accused.

Justice Kakar responded that the application was for physical remand, not for conducting tests. Justice Salahuddin Panhwar added that such tests are not even requested in murder or rape cases, expressing hope that the government would demonstrate the same "efficiency" in cases involving the general public.

Justice Kakar questioned the nature of the case, asking why physical remand was being sought after such a long delay. The Punjab government’s lawyer replied that the accused was not cooperating with the tests. Justice Kakar noted that the accused is already in custody — “How can someone in custody not cooperate?”

Justice Panhwar inquired whether the prosecution had a USB containing evidence. Upon confirmation, he advised them to proceed with forensic analysis instead. The government counsel clarified they were not seeking Khan’s transfer from jail, only his cooperation.

Imran Khan’s lawyer, Salman Safdar, argued that the prosecution had initially obtained a 30-day remand from the trial court without presenting Khan in person, instead using a video link. He added that 14 months passed after the FIR was filed without any arrests or test requests. He claimed that Khan was arrested in this case only after being acquitted in the cypher and "iddat" cases.
